		<description>This law is not designed to protect Maryland retail shops. If that was the case, they would prevent all internet commerce unless Maryland state sales tax was paid. The main reason for this law is simply the state does not know how to manage their finances and alchohol and tobacco have been a whipping boy for governments, both state and local for a billion years. The real question is whether this law will be effective in collecting the OTP tax and the answer is no. By banning Internet sales, Maryland has effectivly said &quot;I am incompetent in collecting this OTP tax from this channel, therefore I am killing the channel&quot;. This is bad government.</description>

		<description>As an Ambassador for Cigar Rights of America, I DON&#039;T SUPPORT Maryland&#039;s HB 88. While it may be good for my local retail business, which is definitely in question, it is not good for the cigar business and sets a bad precedent. that is why Chesapeake Cigar has signed-on to be the in-state litigant of record against HB 88.

Actually, you can&#039;t buy from a Maryland-based Internet store under the new law. There is a nebulous clause that allows a MD retailer to ship up to two packages of cigars to an in-state consumer. The clause doesn&#039;t say whether it&#039;s two total packages EVER, two per year, two per person per year, etc...

The legislation was in no way designed to protect in-state tobacconists. It is a plain and simple plan to collect every last dollar of tobacco tax the state can. As a regular buyer of online cigars, you may have been ignoring the 9.85% tobacco tax that you were supposed to be remitting to the state. Since no one ever paid that tax, the state went in a direction that insured compliance.</description>

		<description>You miss the whole point.  Why do people in Maryland HAVE to buy cigars at retail prices?  What can&#039;t we buy bundles or even singles at &quot;warehouse&quot; prices?  Avoidance of taxes aren&#039;t the issue.  This LAW IS ANTI-CAPITALISM.  You favor it because it eliminates some of your competition.  I am against it because it limits my freedom. 

I am glad to give Uncle Sam every nickel he doesn&#039;t deserve. However, I personally like buying cigars on-line because I really do not feel like paying additional $$$ for the overhead you incur due to maintaining a humidor, leather chairs, TVs, coffee, and providing the tobacconist expertise.  Hmmmm...that additional cost you pass on to me sounds a little like a tax (or fee) for something I really didn&#039;t ask for too.   

But, then you rail against other examples of government intervention (500% tax, no smoking indoors, etc).  

Maybe the answer is that Maryland cigar shops should get competitive and offer internet sales too?  Protectionist policies never have worked and they won&#039;t accomplish anything now.  That said, I&#039;d buy from a MD internet shop if I could.  Otherwise, I&#039;ll be travelling to PA, WV, DC, or VA to get my cigars delivered.</description>
